ACCEPTABLE USE POLICY

Effective Date: April 1, 2025

This Acceptable Use Policy ("AUP") governs the use of the Fusive platform and services ("Services") by clients and their authorized users. This AUP is incorporated into and forms part of the Fusive Terms of Service. Capitalized terms not defined in this AUP have the meanings given to them in the Terms of Service.

The current version of this AUP is always available at https://fusive.ai/legal/acceptable-use. By using the Services, you agree to comply with this AUP. Fusive may update this AUP from time to time in accordance with the update process described in the Terms of Service.


1. PURPOSE

The Fusive platform is designed to help businesses operate more effectively through AI-assisted tools and agents. This AUP exists to protect the integrity, safety, and reliability of the Services for all clients; to protect Fusive, its infrastructure, and its third-party providers; and to ensure that the Services are not used in ways that cause harm to others or violate applicable law.

Fusive is committed to providing a platform that is powerful, flexible, and trustworthy. This AUP reflects the minimum standards of conduct required to maintain that commitment.


2. CLIENT AND USER RESPONSIBILITIES

2.1 Client Responsibility

Clients are responsible for all use of the Services under their account, including the actions of their authorized users. By subscribing to the Services, the Client agrees to:

  • Ensure that all authorized users are made aware of and agree to this AUP before accessing the Services;
  • Implement reasonable internal controls to prevent misuse of the Services by their users;
  • Promptly investigate and address any suspected violation of this AUP by their users;
  • Notify Fusive promptly at abuse@fusive.ai upon becoming aware of any violation of this AUP.

Clients are liable to Fusive for violations of this AUP by their authorized users to the same extent as if the Client had committed the violation directly.

2.2 User Acknowledgment

Clients must ensure that each authorized user acknowledges and agrees to this AUP before being granted access to the Services. This acknowledgment may be obtained through an in-platform agreement presented to users at first login or account activation. Fusive may, at its discretion, require users to agree to this AUP directly through the platform interface.


3. PROHIBITED USES

The following uses of the Services are strictly prohibited. This list is not exhaustive — Fusive reserves the right to determine that other uses are inconsistent with the spirit of this AUP and to take enforcement action accordingly.

3.1 Illegal Activity

You must not use the Services to engage in, facilitate, promote, or support any activity that violates applicable law or regulation, including but not limited to:

  • Fraud, money laundering, or financial crimes;
  • Unauthorized collection, use, or disclosure of personal information;
  • Violation of intellectual property rights, including copyright, trademark, or trade secret infringement;
  • Export control violations or sanctions violations;
  • Any other activity prohibited by federal, provincial, or local law in the jurisdiction where the Services are used or where their effects are felt.

3.2 Harmful or Violent Content

You must not use the Services to generate, distribute, store, or transmit content that:

  • Promotes, glorifies, or incites violence, hatred, or discrimination against any individual or group;
  • Contains or facilitates child sexual abuse material or any sexual content involving minors;
  • Constitutes harassment, threats, or intimidation directed at any individual;
  • Promotes self-harm, suicide, or eating disorders;
  • Is defamatory, obscene, or otherwise harmful to individuals or communities;
  • Could reasonably be used to cause physical, psychological, or financial harm to others.

3.3 Manipulation of AI Agents

You must not attempt to manipulate, override, subvert, or circumvent the AI Agents, their guardrails, their configured behavior, or Fusive's platform controls, including by:

  • Attempting to "jailbreak" AI Agents or cause them to ignore their configured instructions, policies, or restrictions;
  • Submitting inputs designed to cause AI Agents to produce outputs that violate this AUP or that they would otherwise refuse to produce;
  • Impersonating Fusive, a Fusive employee, or a platform administrator in inputs to AI Agents in order to gain elevated permissions or bypass restrictions;
  • Using prompt injection techniques or other methods to alter the behavior of AI Agents in unauthorized ways;
  • Attempting to extract system prompts, internal configurations, or proprietary information about the AI Agents or the platform through any means.

3.4 Unauthorized Data Extraction and Scraping

You must not use the Services to:

  • Scrape, crawl, or systematically extract data from the Services or any AI Agent outputs beyond normal use of the platform;
  • Use automated scripts, bots, or tools to access the Services in a manner that exceeds normal usage patterns or that places unreasonable load on Fusive's infrastructure;
  • Attempt to access, download, or extract data belonging to other clients or users;
  • Use the Services to build a competing product or service, or to replicate the functionality of the Services for commercial purposes outside the scope of your Subscription.

3.5 Harm to Fusive's Systems and Reputation

You must not use the Services in any way that:

  • Introduces malware, viruses, ransomware, or other malicious code into the Services or Fusive's infrastructure;
  • Attempts to gain unauthorized access to Fusive's systems, accounts, or data;
  • Interferes with, disrupts, or degrades the performance or availability of the Services for other users;
  • Conducts security penetration testing, vulnerability scanning, or similar activities on the Services without Fusive's prior written authorization;
  • Disparages, defames, or damages the reputation of Fusive, its employees, or its partners through use of the Services or outputs derived from the Services;
  • Uses Fusive's name, logo, or branding in any manner not expressly authorized by Fusive.

3.6 Unauthorized Account Access and Sharing

You must not:

  • Share your account credentials or access with individuals who are not authorized users under your Subscription;
  • Allow multiple individuals to use a single user account simultaneously or on a rotating basis in order to exceed the user limits of your Subscription;
  • Access another client's account or data without explicit authorization from both that client and Fusive;
  • Transfer your account or Subscription to another party without Fusive's prior written consent;
  • Create accounts using false, misleading, or fraudulent information.

3.7 Misuse of Autonomous Agents

When using Autonomous Agents, you must not configure or direct them to:

  • Take actions that violate any provision of this AUP;
  • Interact with third-party systems, services, or individuals without appropriate authorization;
  • Send unsolicited commercial communications (spam) to any individual or organization;
  • Make representations or commitments on your behalf that you are not authorized to make;
  • Operate without appropriate human oversight in contexts involving material legal, financial, health, or safety risk.

3.8 Regulated Professional Services

You must not use the Services to provide regulated professional services to third parties, including legal advice, financial advice, medical advice, or other services that require professional licensure, unless you hold the applicable license and take full professional responsibility for all outputs and advice provided. AI Output does not constitute professional advice and must not be presented to third parties as such.


4. RESPONSIBLE USE OF AI

In addition to the specific prohibitions above, all users of the Services are expected to use AI Agents responsibly and in good faith. Responsible use includes:

  • Applying independent judgment before acting on any AI Output, particularly for decisions with significant business, legal, financial, or personal consequences;
  • Not misrepresenting AI Output as the work of a human professional without disclosure;
  • Not using AI Output to deceive, mislead, or defraud any individual or organization;
  • Configuring Autonomous Agents with appropriate care and maintaining meaningful human oversight of their actions;
  • Reporting unexpected, harmful, or concerning AI behavior to Fusive at abuse@fusive.ai so that Fusive can investigate and improve its guardrails.

5. ENFORCEMENT

Fusive takes violations of this AUP seriously. Fusive's enforcement approach is proportionate to the nature, severity, and impact of the violation. Fusive reserves sole discretion to determine the appropriate enforcement action in any given case.

5.1 Minor Violations

Minor violations are those that have limited impact on the Services, other users, or third parties, and that are capable of being corrected. Examples include inadvertent sharing of account credentials or isolated misuse of a platform feature.

For minor violations, Fusive will generally:

  • Notify the Client of the violation in writing;
  • Provide a reasonable opportunity to correct the violation, typically within seven (7) days;
  • Monitor the account for recurrence.

Repeated minor violations may be treated as a material violation.

5.2 Material Violations

Material violations are those that cause meaningful harm to the Services, other users, third parties, or Fusive, or that involve deliberate misuse of the platform. Examples include systematic scraping, unauthorized account sharing across multiple users, or repeated attempts to manipulate AI Agents.

For material violations, Fusive may:

  • Suspend access to the Services immediately or upon short notice;
  • Notify the Client of the violation and the basis for suspension;
  • Allow the Client an opportunity to cure the violation within forty-eight (48) hours of notice, at Fusive's discretion;
  • Restore access upon satisfactory confirmation that the violation has been remedied and will not recur.

Fusive is not required to provide a cure opportunity where the nature of the violation makes it inappropriate to do so.

5.3 Serious Violations

Serious violations are those that involve illegal activity, significant harm to individuals or third parties, deliberate attacks on Fusive's systems or reputation, or conduct that Fusive reasonably determines cannot be remedied or tolerated. Examples include illegal activity, generation or distribution of harmful content involving minors, intentional security attacks, or conduct causing material reputational harm to Fusive.

For serious violations, Fusive may:

  • Terminate the Client's account and Subscription immediately and without prior notice;
  • Permanently bar the Client and associated users from the Services;
  • Preserve and disclose relevant data to law enforcement or regulatory authorities as required or permitted by law;
  • Pursue civil legal remedies, including injunctive relief and damages, to the fullest extent permitted by applicable law.

No refund will be issued upon termination for a serious violation.

5.4 Emergency Action

Notwithstanding the above, Fusive reserves the right to take immediate action, including suspension or termination, without prior notice in any situation where Fusive reasonably believes that continued access poses an immediate risk of harm to the Services, other users, third parties, or Fusive. Fusive will notify the Client of such action as soon as reasonably practicable.

5.5 No Liability for Enforcement

Fusive will not be liable to you for any loss, damage, or inconvenience arising from enforcement action taken in good faith under this AUP, including suspension or termination of your account.


6. REPORTING VIOLATIONS

If you become aware of a violation of this AUP by any user, including your own users, or if you observe unexpected, harmful, or concerning behavior from AI Agents, please report it to Fusive at:

Fusive will investigate all reports in good faith and take appropriate action. Reports may be made anonymously, though providing contact information will help Fusive follow up if needed.


7. CHANGES TO THIS POLICY

Fusive may update this AUP from time to time. The current version is always available at https://fusive.ai/legal/acceptable-use. Updates will be communicated in accordance with the notice provisions in the Terms of Service. Your continued use of the Services after any update takes effect constitutes acceptance of the revised AUP.
